1. Acceptance of Terms

By accessing and using the We Are CROly Widget Generator service (provided by MTA Digital Sp. z o.o.), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

1A. Service Description - Free Website Analysis

Analysis Scope: The service analyzes search volume, keyword difficulty, conversion potential, and generates up to 10 widget ideas per analysis. Generated widgets are presentation-quality demos requiring integration into your website.

2. Beta Service & Service Availability

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the service.

3. User Obligations

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account
• You will not use the service for any unlawful purpose
• You will not attempt to interfere with the service's operation

4. Intellectual Property

Your Rights: Generated widgets, code, and widget ideas created through the service are your property. You may use, modify, and implement them freely without attribution (though attribution is appreciated).

Our Rights: The We Are CROly platform, underlying technology, algorithms, AI models, branding, logos, and documentation remain the exclusive property of MTA Digital sp. z o.o. You may not reverse engineer, copy, or redistribute our service.

Third-Party Content: Any libraries, frameworks, or open-source components used in generated widgets are subject to their respective licenses. You are responsible for compliance with third-party licenses.

5. Disclaimers & Limitation of Liability

Limitation of Liability: To the maximum extent permitted by law:

• We are NOT liable for any direct, indirect, incidental, special, consequential, or punitive damages
• This includes but is not limited to: loss of profits, revenue, data, business opportunities, reputation, or goodwill
• Liability arising from: errors in generated code, security vulnerabilities, downtime, service interruptions, data loss, or third-party actions
• Total aggregate liability shall not exceed €100 (one hundred euros) or the amount you paid for paid services (if any)

User Responsibility: You acknowledge that:

• You must review, test, and validate all generated code before production deployment
• You are responsible for compliance with applicable laws (GDPR, accessibility, consumer protection)
• You assume all risks associated with using AI-generated content
• You should implement proper security measures, error handling, and monitoring

6. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the service constitutes acceptance of modified terms.

7. EU/Poland Specific Terms

For users in the European Union and Poland, additional protections apply under GDPR (Regulation EU 2016/679) and Polish data protection law (Ustawa o ochronie danych osobowych):

• You have the right to access, rectify, and delete your personal data
• You have the right to data portability and to restrict processing
• You have the right to withdraw consent at any time
• You have the right to lodge a complaint with the Polish supervisory authority (UODO - Urząd Ochrony Danych Osobowych)
• Data processing is based on your explicit consent (Article 6(1)(a) GDPR)

8. Governing Law

These Terms are governed by Polish law. Any disputes shall be resolved by Polish courts with jurisdiction over Warsaw, Poland, without prejudice to your rights under consumer protection laws.
